Resumen
La Ley 8/2021, de 2 de junio, lleva a cabo una reforma sustantiva y procesal profunda y muy relevante en materia de discapacidad, quince años después de la Convención de la ONU, hecha en Nueva York el 13 de diciembre de 2006. Se analizan los cambios más significativos introducidos por esta nueva norma, que modifica el Código Civil, la Ley de Jurisdicción Voluntaria y la Ley de Enjuiciamiento Civil. A continuación, se analiza el Decreto-ley 19/2021, de 31 de agosto, por el que se adapta el Código Civil de Cataluña a la reforma del procedimiento judicial de la capacidad operada por la Ley 8/2021, de 2 de junio, a fin de armonizar la legislación civil y sustantiva, propia del Derecho Civil catalán, al nuevo paradigma, con la intención de evitar conflictos normativos y contradicciones que puedan ocasionar inseguridad jurídica.
Abstract
Law 8/2021, of June 2, carries out a deep and very relevant, substantive, and procedural reform in the field of disability, fifteen years after the UN Convention, made in New York on December 13, 2006. This work analyzes the most significant changes introduced by this new norm, which modifies the Civil Code, the Law of Voluntary Jurisdiction, and the Law of Civil Procedure. Next, this work analyzes the Decree-Law 19/2021, of August 31, by which the Civil Code of Catalonia is adapted to the reform of the judicial procedure of the capacity operated by Law 8/2021, of June 2, in order to harmonize civil and substantive legislation, proper of Catalan Civil Law, to the new paradigm, with the intention of avoiding regulatory conflicts and contradictions that may cause legal insecurity.
