Resumen
En numerosas ocasiones se viene estimando por la jurisprudencia la viabilidad de la acción pauliana contra las aportaciones sociales a capital efectuadas por el deudor. En este trabajo tras haber expuesto los razonamientos de dicha jurisprudencia en otro anterior, hemos abordado los requisitos generales y particulares que han de ponderarse para la aplicación del recurso pauliano en el supuesto analizado.
Abstract
On numerous occasions case law has upheld the viability of revocatory action against capital contributions made by a debtor involved in bankruptcy proceedings. Having laid out the reasoning behind said case law in a previous paper, in this paper we have addressed the general and individual requirements that must be weighed for the application of an appeal for revocation in the analysed circumstances.
