Resumen
Seamos sinceros, los robots nos dan miedo. Este sentimiento ha sido en gran parte forjado por el cine: robots que controlan la tierra y convierten a los humanos en sus esclavos. Si seguimos siendo sinceros, nadie quiere renunciar a una herramienta con el potencial de la inteligencia artificial. Ante ambas opiniones de miedo y necesidad el recurso al Derecho es imperante para establecer las reglas y las pautas que marquen nuestra relación con los robots, actuales y futuros, y con los cambios que provocará en nuestra sociedad. El avance de la tecnología muestra que es vital la investigación desde la perspectiva jurídica, mostrando especial interés en la responsabilidad civil que deriva de los daños generados por máquinas cada vez más inteligentes y autónomas y en la privacidad y transparencia en el manejo de datos. En el presente estudio se conecta el Derecho Civil con los avances tecnológicos y los problemas jurídicos que de ellos derivan. Se debate en estas líneas de forma particular cuestiones como la conveniencia de una rama específica para la materia, la atribución de personalidad a estos entes tecnológicos, la orientación que debe seguir la responsabilidad civil por los daños provocados por los sistemas más autónomos y el camino que hay que recorrer para proteger eficazmente nuestra privacidad. Es el momento, tras las publicaciones sobre la materia, de recapitular y repensar para seguir avanzando.
Abstract
Let's be honest, robots scare us. This feeling has been largely forged by the cinema: robots that control the earth and turn humans into their slaves. If we remain honest, no one wants to give up a tool with the potential of artificial intelligence. In the face of both opinions of fear and necessity, recourse to the law is imperative to establish the rules and guidelines that will mark our relationship with robots, present and future, and with the changes that it will bring about in our society. The advance of technology shows that research from a legal perspective is vital, showing special interest in the civil liability that derives from the damage generated by increasingly intelligent and autonomous machines and in the privacy and transparency in the handling of data. This study connects civil law with technological advances and the legal problems that derive from them. It discusses in particular issues such as the suitability of a specific branch for the subject, the attribution of personality to these technological entities, the orientation that civil liability should follow for damages caused by more autonomous systems and the path to be followed to effectively protect our privacy. It is time, after the publications on the subject, to recapitulate and rethink in order to continue moving forward.
