Este comentario tiene como objetivo detenerse en un nuevo daño indemnizable.
El tema que pretendemos abordar tiene como eje la compensación del daño que se le produce a una madre que, teniendo derecho a que sus hijos vuelvan con ella, ve frustrado su derecho al no producirse el retorno, por haber transcurrido largo tiempo desde que los menores se separaron de su familia de origen. Se trata de un tema de gran interés.
Abstract
This objective of this commentary is to examine at length a new kind of indemnifiable damage. The core of our subject is compensation for the damage done to a mother when she has the right to have her children return to her and this right is frustrated because the children do not return, as it has been a long time since the children were separated from their family of origin. The issue is one of great interest.
