Resumen
La privación de las relaciones de uno de los progenitores con sus hijos por impedirlo el otro progenitor, independientemente de que se trate de imposibilitar el ejercicio de la guarda y custodia o simplemente se trate del impedir el régimen de visitas, ha sido considerada por el Tribunal Supremo como causa de un daño efectivo, un daño moral. Al estimarse en el supuesto analizado que existen los requisitos exigidos para que haya una responsabilidad extracontractual, un hecho, un daño y una relación de causalidad entre ambos. En este sentido, el Tribunal Supremo está en la línea de las Resoluciones del Tribunal Europeo de los Derechos Humanos, quien considera que constituye una violación del derecho a la vida familiar el impedir que los padres se relacionen con sus hijos habidos dentro o fuera del matrimonio.
Abstract
Depriving parent A of spending time with his or her children because the other parent B prevents parent A from doing so, regardless of whether it is a case of making it impossible for A to exercise guardianship and custody or simply by preventing A from visitation, has been regarded by the Supreme Court as the cause of a kind of actual damage, mental anguish. The Supreme Court considers that the requirements for extra-contractual liability to exist -an event, damage and a causal relationship between the event and the damage- are met. In this sense, the Supreme Court is in line with the European Court of Human Rights, which considers preventing parents from spending time with their children, born of or outside their marriage, constitutes a violation of the right to family life.
