Resumen
La problemática que suscita el tema de la vivienda familiar en supuestos de crisis matrimoniales es uno de los asuntos que tiene planteados, hoy en día, el Derecho de Familia. Cuando uno de los cónyuges está enfermo, con una enfermedad grave, y sin grandes posibilidades de curación, al menos a corto plazo, la vivienda se atribuye, por nuestra doctrina jurisprudencial al cónyuge que se encuentra en esta precaria situación física (o psíquica). En esta doctrina, a mi juicio, lo que salta a la vista es la solidaridad humana, y el no hacer recaer las consecuencias, casi siempre perjudiciales para uno de los esposos, en el cónyuge que padece una patología grave (o degenerativa). De esta forma, con buen criterio, desde mi punto de vista, se hace prevalecer el interés de la familia como el más necesitado de protección, tal como nuestro Código Civil indica, lo cual es loable, merece elogios a todos los efectos.
Abstract
The problem issue of the family home in marital crises is one of the big subjects for family law nowadays. When one of the spouses is seriously ill and unlikely to get well at least in the short term, our country’s case law awards the home to the spouse who is in this precarious physical (or mental) situation. What leaps to the eye is, in my opinion, the humane solidarity of this kind of legal thought and the way a person with a serious (or degenerative) illness is shielded from the consequences, which are almost always harmful for one of the spouses. Thus, with good judgment, from my point of view, the interest of the family is made to prevail, because it is the interest that most needs protection, just as our Civil Code says. This is commendable and deserves praise on every point.
