HACIA UNA MEJORA DE LA CALIDAD EN LA PRODUCCIÓN NORMATIVA (BETTER REGULATION).

Resumen
La seguridad jurídica que, en función preventiva, brindan escribanos y registradores, propicia las inversiones y dinamiza la economía. La inflación normativa genera problemas a los operadores jurídicos, y depende, en general, de la concepción que se tenga de cuál debe ser el desempeño del Estado respecto a la sociedad civil. El entramado de normas de diversa jerarquía hace que la actividad sea cada vez más compleja y ubica al ciudadano ante un cúmulo de normas muchas veces incoherentes y repetitivas. Los países tie- nen un creciente interés por los efectos económicos, sociales, medioambientales y de toda índole derivados de la legislación. El movimiento que procura la mejora de la calidad normativa (better regulation), no tiene un componente ideológico, sino que es una forma pragmática de mejora normativa, cuantitativa y cualitativa, así como de buena administración. Se trata de un bien público en sí mismo, que intenta no disminuir sin más el número de normas, sino de analizar su impacto, reducir costes y cargas administrativas. La medición ex-ante y ex-post del instrumento normativo facilitará, a su vez, un buen gobierno de los Estados y, en definitiva, simplificará la vida de los ciudadanos.
Abstract
The legal certainty that notaries and registrars provide as a preventive function fosters investments and energises the economy. Legislative inflation causes problems for judicial operators, and whether or not inflation exists generally depends on the conception one has of what the state's job is with respect to civil society. The dense fabric of rules and regulations of varying hierarchical levels makes activity increasingly complex and brings citizens up against an accumulation of often incoherent, repetitive regulations. Countries are taking a growing interest in the economic, social, environmental and all other effects that legislation has. The movement for better regulation does not have an ideological component. It is instead a pragmatic form of quantitative and qualitative legislative improvement and good administration. It is a public asset in itself, one that strives not purely and simply to reduce the number of regulations, but to analyse the impact of regulations and reduce costs and administrative burdens. Measuring legislative instruments before and after the fact will in turn facilitate the good governance of states and, in short, will simplify citizens' lives.
