Resumen
En la legislación hipotecaria español existen diversos artículos que exigen que determinados documentos privados vengan con la firma autógrafa del firmante legitimada por un notario público para su presentación y despacho en el Registro. Por ello, analizamos en este trabajo la cuestión de si este requisito de la legitimación notarial de firma debe seguir siendo aplicado cuando un documento electrónico que ha sido firmado con un certificado electrónico cualificado de firma, conforme al Reglamento (UE) n° 910/2014 del Parlamento Europeo y del Consejo, de 23 de julio de 2014, relativo a la identificación electrónica y los servicios de confianza para las transacciones electrónicas en el mercado interior, se presenta ante el registro.
Abstract
In Spanish mortgage legislation, there are several articles that require certain private documents to come with the signature of the signer, authenticated by a notary public, for presentation and dispatch in the registry. Therefore, we analyze in this work the question of whether this requirement of notarial signature legitimacy should continue to be applied when an electronic document that has been signed with a qualified electronic signature certificate, in accordance with Regulation (EU) No. 910/2014 of the European Parliament and of the Council, of July 23, 2014, regarding electronic identification and trust services for electronic transactions in the internal market, is presented to the registry.
