Resumen
El deber de los padres de sufragar los gastos de crianza y educación del hijo mayor de edad solo puede darse cuando el hijo que no ha terminado su formación mantenga una actitud diligente, porque de lo contrario deja de ser razonable exigir a los padres sufragar sus gastos. El Tribunal Supremo acepta la extinción de la pensión de alimentos de un progenitor para con hijos mayores de edad, por ausencia continuada de relación de estos hacia aquel, por causa principal, relevante e intensa imputable al alimentista, haciendo hincapié en la necesaria prueba rigurosa y restrictiva de la falta de relación manifiesta y de que ésta sea imputable, de modo principal, y relevante, al hijo.
Abstract
The parents' duty to defray the costs of raising and educating the child of legal age can only occur when the child who has not completed his / her education maintains a diligent attitude, because otherwise it is no longer reasonable to require the parents to defray his expenses. The Supreme Court accepts the extinction of the maintenance of a parent with children of legal age, due to the continued absence of a relationship between them, for the main, relevant and intense cause attributable to the obligee, emphasizing the necessary rigorous proof and restrictive of the manifest lack of relationship and that this is attributable, in a main and relevant way, to the child.
