Resumen
Este artículo tiene por objeto el estudio de la novedosa regulación de la propiedad compartida del Código civil de Cataluña. El legislador catalán, a través de la ley 19/2015, de 29 de julio, incorporó la propiedad temporal y la propiedad compartida en el libro v de los derechos reales. Se desprende del Preámbulo de dicha ley que el objetivo del legislador de Cataluña no es otro que crear nuevas tenencias que permitan acceder a una vivienda en propiedad de una forma más flexible y que no comporten un sobreendeudamiento para los particulares. Por este motivo, el legislador de Cataluña se ha inspirado en la shared ownership inglesa, una forma de tenencia inmobiliaria que permite adquirir cuotas graduales de dominio, en función de las posibilidades económicas, hasta adquirir el pleno dominio por el comprador. la importación de la shared ownership en el Código civil de Cataluña se ha llevado a cabo mediante la creación de una comunidad especial de bienes donde coexisten, al mismo tiempo, dos comuneros que la ley denomina «propietario material» y «propietario formal», pues es el primero de ellos el que irá adquiriendo progresivamente el dominio, en virtud del derecho de adquisición gradual, y el que tiene la posesión y el goce exclusivo del bien.
Abstract
The purpose of this paper is to study the regulation of the shared ownership of the Catalan Civil Code. The Catalan Lawmaker, through Act 19/2015, of July 29, incorporated the temporal ownership and the shared ownership in the fifth Book of real rights.
It follows from the Preamble of this law that the objective of the Catalan Lawmaker is to create new tenures to make housing more affordable in a more flexible way and that not entailing an over-indebtedness for people. The Catalan lawmaker has been inspired by the English shared ownership, a tenure that al- lows the acquisition of gradual shares of ownership, depending on the economic possibilities, until acquiring the full ownership by the buyer.
The importation of the shared ownership in the Civil Code of Catalonia has been carried out through the creation of a special community of goods where two share holders coexist which the law calls "material shareholder" and "formal shareholder". It is the first one which will progressively acquire more shares of ownership due to the right of staircasing and the one which has the exclusive possession and enjoyment of the good.
