Resumen
El nuevo marco legal, surgido a propósito de la reforma de la Ley Hipotecaria tras la entrada en vigor de la Ley 13/2015, ha permitido clarificar, en cierto modo, la resolución de las diferentes situaciones conflictuales surgidas en el ámbito registral, produciéndose un avance en dos sentidos. De un lado, en la desjudicialización de este tipo de procedimientos y, de otro, al establecer un mecanismo que permita identificar gráficamente las fincas registrales tratando de evitar, con ello, la generación de la doble o, en general, múltiple inmatriculación registral. Precisamente, en relación con este último aspecto, ciertamente innovador resulta el contenido del artículo 209 LH, al elevar una regulación tan específica a rango legal, y producirse un vaciamiento de facto del contenido de la normativa de carácter reglamentario, regulador con carácter previo de la materia.
Abstract
The new legal framework, which emerged as a result of the reform of the Mortgage Law after the entry into force of Law 13/2015, has made it possible to clarify, in a way, the resolution of the different conflict situations arising in the registration field, with two-way progress being made. On the one hand, in the dejudicialization of such procedures, of another, by establishing a mechanism that allows to graphically identify the logging farms thus avoiding the generation of double or, in general, multiple logging immatriculation. Precisely, in relation to the latter aspect, it is certainly innovative that the content of Article 209 LH is, by raising such specific regulation to legal range, and there is a de facto emptying of the content of the regulatory legislation on the subject.
