Resumen

El 27 de julio de 2012 se publicó el Reglamento (UE), número 650/2012, del Parlamento Europeo y del Consejo, de 4 de julio de 2012, relativo a la competencia, la ley aplicable, el reconocimiento y la ejecución de las resoluciones, a la aceptación y la ejecución de los documentos públicos en materia de sucesiones mortis causa y a la creación de un certificado sucesorio europeo. Esta iniciativa hay que ubicarla en el contexto de las libertades básicas y derechos fundamentales que informan el ordenamiento jurídico de la Unión Europea como la libre circulación de personas o la protección del derecho de propiedad, derechos y libertades que deben desarrollarse en el contexto actual de una realidad en la que la movilidad internacional de las personas aumenta constantemente y, en paralelo, aumenta también el número de sucesiones internacionales, situaciones frente a las que las legislaciones nacionales europeas en la actualidad ofrecen soluciones fragmentadas y en ocasiones divergentes e incoherentes. Frente a este panorama, sale al paso el nuevo Reglamento sucesorio europeo que pretende fijar reglas uniformes de Derecho internacional privado en materia de competencia de autoridades, ley aplicable y reconocimiento y ejecución de resoluciones y actos auténticos en materia sucesoria, y que crea un novedoso certificado europeo de sucesiones en que se combinan todos los aspectos anteriores. El objeto del presente artículo estriba en analizar fundamentalmente el tema de la delimitación de la ley aplicable, los límites que impone la lex rei sitae a la lex successionis, el principio de adaptación de los derechos reales como técnica de armonización de ambas, y su proyección tanto en el ámbito del reconocimiento y ejecución de resoluciones como en la nueva figura del certificado sucesorio europeo, y las relaciones de este último con el Registro de la Propiedad.

Abstract

On 27 July 2012 Regulation (EU) No 650/2012 of the European Parliament and of the Council of 4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and on the creation of a European Certificate of Succession was published. This initiative belongs within the context of the basic freedoms and fundamental rights that shape the laws of the European Union, such as the right to free circulation of persons and the right to protection of property rights. These rights and freedoms must be applied in today's context of a reality in which the international mobility of persons is constantly on the rise, along with a mounting number of international successions. The solutions offered at present by the domestic legislation of European countries are fragmentary at best, divergent and incoherent at worst. To address this panorama the new European Succession Regulation has arisen, which attempts to set uniform rules of international private law in matters of authorities' jurisdiction, the applicable law and the recognition and enforcement of decisions and authentic acts in matters of succession. The regulation creates a novel European certificate of successions that combines all the points mentioned above. The object of this article is to analyze fundamentally the delimitation of the applicable law, the limits the lex rei sitae sets on the lex successionis, the rule of adaptation of rights in rem as a technique for harmonizing the lex rei sitae with the lex successionis, and the influence of this on the recognition and enforcement of decisions, on the new concept of the European certificate of succession, and on the relationships of the European certificate of successions with property registration systems.
