EL RÉGIMEN DE COLACIÓN DE GASTOS EN EL CÓDIGO CIVIL.

Resumen
Por el presente trabajo se realiza un estudio de la institución de la colación, si bien, centrándose en unos preceptos concretos, como son los artículos 1.041 a 1.044, aquellos que abordan el objeto de la colación, o sea, las liberalidades o atribuciones excluidas e incluidas en la misma. Lo que nos sitúa ante los gastos ocasionados por alimentos, educación y aprendizaje, curación de enfermedades, equipo ordinario, regalos de costumbre, necesidades especiales, pagar sus deudas, conseguirles un título de honor.
Se trata de una serie de preceptos faltos de una redacción acorde con la actualidad, por ello necesitan que se realice una reinterpretación de acuerdo con la realidad social del tiempo. Todo ello nos ha conducido a que, en determinados casos, aboguemos por su derogación.
Planteado así el estudio, cabe poner de relieve que no nos adentramos en otras cuestiones, como pueden ser los presupuestos, fundamento, naturaleza o valoración de los bienes colacionables.
No nos referimos a los distintos actos o negocios jurídicos a título gratuito que pueden ser objeto de colación, sino que incidimos sobre los gastos, propiamente dichos, con independencia de la institución que ha servido de base para realizar esa liberalidad. Con la excepción de la donación remuneratoria a la que dedicamos unas líneas por las particularidades que comporta. Además, se trata el régimen de colación respecto de algo que no son, propiamente, donaciones, sino «gastos» que el causante realiza en vida debido a la especial relación y, en algunos casos, porque está obligado a ello.
Abstract
This paper studies the institution of the hotchpot, although it focuses specifically on articles 1.041 to 1.044, which address the object of the hotchpot, i.e., the liberalities or advancements excluded and included therein. Thus we look at expenditures paid for food, education and learning, medical treatment, ordinary outfitting, customary gifts, special needs, payment of debts, achievement of a title.
Articles 1.041 to 1.044 are not worded for use in the present day. Therefore they need to be reinterpreted in tune with the social realities of the times. We are therefore led in certain cases to espouse their repeal. Looking thus at the study, it might be stressed that we do not enter into other issues, such as the events, foundation, nature or appraisal of the assets in a hotchpot. We do not refer to the different gratuitous legal acts that may be included, but instead we emphasize expenditures proper, independently of the institution that served as the basis for the liberality, with the exception of remunerative gifts, to which we dedicate a few lines due to the special features therein entailed. In addition, there is discussion of the hotchpot regimen with respect to things that are not properly gifts, but «expenditures» that the testator makes in life due to the special relationship and in some cases because the testator is obliged so to do
