Resumen
En la práctica de los tribunales la restitución de la fianza arrendaticia viene siendo exigida por el arrendatario tanto en un procedimiento monitorio, como en un juicio verbal o en un juicio ordinario, sobre todo por parte de quienes lo hacen sin postulación procesal. Sin embargo, la necesidad de que se liquide previamente la relación arrendaticia hace preciso que el procedimiento declarativo idóneo lo sea por razón de la cuantía. No puede conseguirse directamente un título ejecutivo por no ser líquida, determinada, vencida y exigible la cuantía de la fianza que el arrendador deberá devolver al arrendatario tras finalizar el arrendamiento.
Abstract
In the practice of the courts the restitution of rental deposit is required with the payment procedure or with verbal judgment or an ordinary trial, especially by those plaintiffs that not need lawyer and procurator. However, the finish of rental agreement needs a declarative procedure of amount. Is not directly achieved an executive title because the amount of the bond is not liquid and determined.
