Resumen
En España el número de adopciones internacionales supera con creces el número de adopciones internas, siendo esta una figura de raíces muy antiguas que se ha visto en la actualidad influida por numerosos factores que la han llevado a colocarse en el punto de mira del legislador, siendo objeto de una sucesiva y premiosa reforma legislativa cuyos ejes centrales se encuentran en la actualidad en el Código civil, loPJ, lEC, lai, legislación de las comunidades autónomas y ley 26/2015, de 28 de julio, de modificación del sistema de protección a la infancia y a la adolescencia. todo ello aderezado con los principios básicos de la Convención de las Naciones unidas sobre los derechos del niño de 1989 y el Convenio de la Haya sobre protección del niño y cooperación en materia de adopción internacional de 1993.
Es por ello el objeto de este estudio fijar nuestra atención en la legislación española en relación a dos aspectos: de un lado, señalar los itinerarios legales para la constitución de la adopción internacional, destacando el papel y funciones de los diferentes órganos, administrativos y judiciales que intervienen; y de otro lado, de manera práctica y sintética, indagar en los requisitos necesarios para llevarla a cabo, sin perder de vista que nos encontramos ante una materia extraordinariamente jurídica pero sobre todo extraordinariamente humana.
Abstract
In Spain the number of international adoptions outweighs dearly the number of domestic adoptions, being these a very old-rooted concept which has been currently influenced by numerous factors which have led it to become the target of the law-maker. Thus, international adoptions are the objec- tive of a consecutive and laboured amendment whose main axes can be found nowadays in the Spanish Civil Code and the Acts LOPJ, LEC, LAI, legislation from the Autonomous Communities and the act Ley 26/2015 de 28 de julio, which modifies the children and adolescents protection scheme. All of which seasoned with the basic principles of the Convention of the United Nations on the children rights 1989 and the Hague Convention on children protection and cooperation with regard to international adoption, 1993.
Therefore, the aim of this study is to focus our attention on the Spanish legislation considering two aspects. On the one hand, to point out the legal paths to establish an international adoption and to highlight the roles and functions of the various administrative and judicial authorities. On the other hand, in a practical and synthetic way, to investigate the necessary requirements, without forgetting that we are in front of extraordinarily legal matters, but above all, extraordinarily human matters.
