Resumen
El mandato se realiza en interés del mandante aunque nada impide que el mandato pueda concebirse en interés de personas distintas y, en concreto, del mandatario, además suele ser representativo, pues se caracteriza por conferir el mandante su representación al mandatario para uno o varios asuntos, pues el mandatario actúa en nombre e interés ajeno para que los efectos de su actuación recaigan sobre la persona del representado, pero también cabe el mandato simple en el supuesto de que el mandatario actúe en nombre propio y prevé que sea el mandatario quien se obligue directamente frente a la persona con quien ha contratado.
Abstract
Mandates are given in the interest of the mandator, although there is nothing to prevent a mandate from being conceived in the interest of someone else, specifically, the mandatary.
Furthermore, mandates are generally used as a means of allowing the mandator to empower the mandatary to represent the mandator in one or more affairs; there, the mandatary acts in the name and interest of another person, so that the effects of the mandatary's acts fall upon the mandatary's principal. However, there is also such a thing as a simple mandate, where the mandatary acts in his or her own name and is the person who is directly bound vis-à-vis the person with whom the mandatary has made the contract.
