EL DERECHO A LA INTIMIDAD FAMILIAR Y EL DAÑO MORAL EN LA JURISPRUDENCIA.

Resumen
El ámbito de la intimidad personal y familiar es donde residen los valores humanos y familiares; constituye un derecho fundamental para el desarrollo de la persona y de la familia. Es fundamental por su propia esencia de privacidad, la cual se protege frente a la curiosidad de los demás. Su reconocimiento como derecho fundamental tiene por objeto su garantía (art. 10.1 CE), frente a la acción y el conocimiento de los demás, sean estos poderes públicos o simples particulares. El daño moral ocasionado por la intromisión ilegítima en dicho ámbito es de creación jurisprudencial, debe ser probado por quien lo reclama. El juez valora los daños conforme a las exigencias de la equidad, y en atención solo a las circunstancias del caso concreto, pues el daño moral es el impacto o sufrimiento psíquico o espiritual producido por agresión directa al acervo extrapatrimonial o de la personalidad (ofensas a la fama, al honor, a la honestidad) y su reparación no va dirigida a cubrir una pérdida material, sino como compensación al sufrimiento causado.
Abstract
It is in the sphere of personal and family privacy where human and family values reside. In that sphere one is protected from the curiosity of others. The fundamental right to privacy was acknowledged (Spanish Constitution, article 10.1) to ensure people's privacy against the action and knowledge of others, whether public authorities or simply private citizens. The mental anguish caused by unlawful intrusion into the private sphere is a creation of case law and must be proved by the claimant. The judge weighs the damage pursuant to the requirements of fairness, factoring in only the circumstances of the particular case at hand, for mental anguish is the mental or spiritual impact or suffering caused by a direct attack against the victim's non-economic or personal aspects of self (offending a person's reputation or personal honour or casting doubt on the person's honesty), and reparations are not intended to cover a physical loss, but to provide compensation for the suffering caused.
