Resumen
Los presupuestos básicos de la redacción y contenido del artículo 1035 del Código civil común y la colación como norma de reparto y anticipo de la herencia, desencadenan que si concurren herederos forzosos, dicha colación solo se empleará entre ellos. Por su parte y frente a la computación de la legítima, será imputable si hubiere donaciones que pudieren perjudicar a los legitimarios.
Abstract
The basic assumptions of the wording of article 1035 of the law spanish common Civil Code and method of distribution, as a rule of distribution and advance payment of the inheritance, mean that if there are forced heirs, snacking can only take place between forced heirs. For its part, and with regard to the computation of the legitimate one, it will be applicable if there are donations that could harm the legitimate ones.
