Resumen
El Covid-19 ha intensificado el sentimiento de desapego y la soledad de los mayores desatendidos, sin embargo la ley determina que solo bajo unas causas tasadas pueden los padres excluir del testamento a sus familiares. Nos preguntamos si en la nueva realidad social, cada vez más frecuente, la de los mayores dependientes que son ignorados literalmente por sus familias, la ausencia manifiesta y continuada de relación familiar entre el causante y el legitimario es causa de desheredación.
Abstract
The Covid-19 has intensified the feeling of detachment and loneliness of the neglected elderly, however the law states that only under certain taxed causes can parents exclude their relatives from the will. We wonder if in the new social reality, more and more frequent, that of dependent elderly people who are literally ignored by their families, the manifest and continued absence of family relationship between the deceased and the legitimate should be a cause of disinheritance.
