Resumen

El Renacimiento refleja una inquietud creadora en la búsqueda de certeza y seguridad, con un mayor margen de libertad, a lo que ayuda una óptica menos geocéntrica, y una mayor confianza del hombre en sí mismo (CHERTESTON, ORTEGA, GALILEO, DESCARTES). El hecho renacentista español tiene parecidas características en razón a los ocho siglos de Reconquista, y una erosión al Derecho romano o germánico, además por la singularidad del Descubrimiento de América.
La necesariedad de «pactar» Iglesia -Católica- y Poder Real, respecto a los títulos de las tierras «descubiertas», con la pertenencia de los hombres-fieles de la Iglesia. Esto obligó a que los teólogos juristas de la Escuela Española del siglo XVI, en sus formulaciones para la convivencia y resolución de conflictos, a través del Derecho de gentes y las Leyes de Indias buscasen la certeza legal y seguridad jurídica. Con el tiempo se haría principio y Derecho humano y aun constitucional.
Aplicable a la guerra justa, o a la dinámica de las relaciones patrimoniales e inmobiliarias. Otras aportaciones se encuentran en el nuevo derecho a la educación y formación que nace en José DE CALASANZ, creador en el siglo XVI de las primeras escuelas populares cristianas, y Miguel SERVET, jurista del mismo siglo, que vivió la inseguridad de tres instancias inquisitoriales y un proceso centrado en bases populistas y calvinistas, sin las garantías y tolerancia de la que SERVET fue el primer formulador como derecho.

Abstract

The Renaissance reflects a creative restlessness in the search for certainty and security, with a greater margin for freedom, which is helped along by a lessgeocentric view and man's greater confidence in himself (CHESTERTON, ORTEGA, GALILEO, DESCARTES). The Spanish Renaissance event has similar characteristics because of the eight centuries of Reconquest, and an erosion of Roman or Germanic law. In addition, because of the singularity of the Discovery of America.
The necessity of making «pacts» between the (Catholic) Church and royal power, with respect to titles to the «discovered» lands, with ownership for the Church's reliable men. This forced juristic theologians of the sixteenth-century Spanish school, in their formulations for coexistence and conflict resolution, through the right of peoples and the Laws of the Indies, to seek legal certainty and legal security. With time this became a principle and a human right, even a constitutional right. Applicable to fair warfare, or to the dynamics of asset and real-estate relations. Other contributions are found in the new right to education and training that was born in José DE CALASANZ, sixteenth-century creator of the first Christian commoners' schools, and Miguel SERVET, jurist of the same century, who experienced the insecurity of three inquisitorial proceedings, and a process centring on populist, Calvinist foundations, without the guarantees and tolerance that SERVET, was the first to formulate as a right.
