Resumen
El estatuto peculiar de la tierra definido como «los Estados del Duque de Medinaceli» constituye un ejemplo paradigmático de la polémica vigencia de un Derecho arcaico y de corte feudal en un territorio bien definido dentro de Castilla-La Mancha. Consta en la Escritura de Concordia de 5 de mayo de 1552, rubricada por sanción regia en la Real Cédula de 11 de junio de 1553. Posteriormente la Ley 5/1980, de 22 de febrero, «relativa a las medidas para resolver el problema de los derechos históricos en la comarca de Malagón y para promover el desarrollo integral de la misma», recoge su contenido. El estudio versa sobre la naturaleza de dicho régimen, más transacción que fuero, la identificación subjetiva y objetiva de los derechos que contempla, con su posible categoría de servidumbre personal frente al dominio compartido que alguna sentencia propuso. Por último, se debate la posible inconstitucionalidad sobrevenida del sistema.
Abstract
The peculiar status of the land defined as «the States of the Duke of Medinaceli» represents a paradigmatic example of the controversial validity of an archaic and feudal Law in a well-defined territory in Castilla-La Mancha. It is recorded in the Deed of Concord of May 5, 1552, initialled by sanction in the Royal Decree of June 11, 1553. Subsequently, Law 5/1980, of February 22, concerning the measures to solve the problem of the historical rights in the community of Malagón and to promote its integral development, collects its content. The study deals with the nature of this regime, more transaction than jurisdiction, the subjective and objective identification that the rights that it contemplates, with its possible category of personal servitude. Finally, it argues a posible ensuing unconstitutionality of the system.
