Resumen
El nombre y apellidos se configuran como un elemento de identidad del nacido derivado de su derecho de la personalidad y como tal se incorpora a la inscripción del nacimiento. La filiación determina los apellidos; por lo que, si está determinada por ambas líneas, los progenitores acordarán el orden de los apellidos antes de la inscripción registral. En caso de desacuerdo o cuando no se hayan hecho constar los apellidos en la solicitud de inscripción, se acordará por el Encargado del Registro atendiendo al interés superior del menor. En este contexto, el presente estudio se va a centrar en la determinación del nombre y en especial, del orden de los apellidos en diferentes situaciones legales y su posible cambio mediante declaración de voluntad o mediante expediente, o en caso de que tengan lugar circunstancias excepcionales, su posible conservación por agregación, o en supuestos de violencia de género o violencia vicaria o, en fin, en que se ha modificado el nombre, apellidos y la identidad de la persona tras la Ley Trans y LGTBI.
Abstract
The name and surnames are configured as an element of identity of the born derived from his right of personality and as such is incorporated into the birth registration. The filiation determines the surnames; Therefore, if it is determined by both lines, the parents will agree on the order of the surnames before the registration. In case of disagreement or when the surnames have not been stated in the registration application, it will be agreed by the Registrar in charge of the best interest of the minor. In this context, the present study is centre to the determination of the name and, in particular, the order of the surnames in different legal situations and its possible change by means of a declaration of will or by means of a file, or in the event of exceptional circumstances, its possible conservation by aggregation, or in cases of gender violence or vicarious violence or, finally, in which the name, surnames and identity of the person have been modified after the Trans and LGTBI Law.
