Resumen
Desde la perspectiva del derecho de autor español, dos sentencias del Tribunal de Justicia de la unión europea (TJUE) de los años 2016 y 2017 —asuntos C-99/15 y C-367/15— representan un revulsivo para la doctrina jurisprudencial sobre el daño moral por infracciones de los derechos de autor y de otros derechos de propiedad intelectual. Por un lado, el TJUE confirma que la parte perjudicada por una infracción de su derecho de propiedad intelectual puede reclamar una indemnización por el daño patrimonial calculada sobre la base de una regalía hipotética y además solicitar la reparación del daño moral; y, por otro lado, ha reconocido que la directiva 2004/48/CE no cierra las puertas al mecanismo del daño punitivo para infracciones de los derechos de propiedad intelectual. este trabajo propone un acercamiento a estos criterios, con el fin de reflexionar sobre las funciones de la responsabilidad civil en nuestro sistema de infracciones del derecho de autor, y en el futuro de la reforma de la citada directiva.
Abstract
From the perspective of Spanish copyright law, two judgments of the Court of Justice of the European Union (CJEU) published in 2016 and 2017 —Case C-99/15 and Case C-367/15— represent an important change in jurispruden- tial doctrine on moral damage for infringement of copyright and other intellectual property rights. On the one hand, the CJEU confirms that the party injured by an infringement of their intellectual property right can claim compensation for the material damage calculated according on the basis of hypothetical royalty and also to claim compensation for the moral damage; and, on the other hand, it has been recognized that Directive 2004/48/EC does not close the doors to the punitive dam- ages mechanism for infringements of intellectual property rights. This work proposes an approach to the new criteria, show the functions of tort law in our legal system and the future of the reform of the Directive.
