Resumen
Este trabajo analiza los criterios normativos de imputación objetiva y su manejo como herramientas auxiliares por parte de la jurisprudencia para exonerar totalmente al agente físico dañoso en caso culpa exclusiva de la víctima (o, parcialmente, en caso de culpa concurrente). El estudio examina cada uno de los criterios y su conexión con la culpa de la víctima bien para imputarle el daño a ésta, incluso en casos en que puede haber una culpa del agente dañoso que se torna en causalmente irrelevante (riesgo general de la vida, con particular análisis de las predisposiciones dañosas; fin de protección de la norma; incremento del riesgo; prohibición de regreso); bien para imputarle el daño al agente cuando sólo su culpa es causativa (principio de confianza) o en supuestos en que es él quien ha provocado la conducta autodañosa de la víctima (provocación). La jurisprudencia acude también, para liberar al agente del daño, al criterio de la competencia de la víctima, cuando el control de la situación le correspondía a ésta; y al de la adecuación, si considera que su conducta es la causa eficiente del daño que padece.
Abstract
This paper analyzes the different normative criteria of objective imputation (causality in law) and their management as auxiliary tools by the jurisprudence to exclude liability in case of exclusive fault of the victim (or to reduce it, in case of contributory fault). The study examines each one of the criteria and their connection with the victim's fault in order to account the damage to the victim, even in cases where the tortfeasor is at fault (general life risks, with particular analysis of the preexisting condition or susceptibility; breach of statutory duties; increase in risk; remoteness), or to account the damage to the tortfeasor when only his fault is causative (bilateral care) and in cases in which he is the one who has provoked the victim's self-harming behavior (provocation). The jurisprudence also resorts, in order to exonerate the tortfeasor, to the criterion of the victim's competence, when the control of the situation corresponded to him, and the criterion of foresight test, if it considers that his conduct is the efficient cause of the damage suffered.
