Resumen
Las funciones de la institución de la patria potestad han estado vigentes durante todo el estado de alarma decretado por el Gobierno, así como en los posteriores periodos de confinamiento instaurados para intentar prevenir el virus. Para la resolución de los conflictos se ha tenido en cuenta el interés superior del menor, a fin de evitar a los hijos perturbaciones dañosas en los casos de cambio de titular de la potestad de guarda o de evitarle perjuicios en su entorno familiar o frente a terceras personas. La declaración del estado de alarma no legitimó el incumplimiento de resoluciones judiciales. Con la obligatoriedad de presencialidad en los centros escolares de los menores han surgido nuevos problemas como los que se plantean cuando hay un problema de salud grave de un conviviente del menor, pues debería valorarse el caso por las autoridades educativas a fin de ser eximido de acudir al colegio. La cuestión reside en que no existe en nuestro país una regulación alternativa a la presencialidad que sí ofrecen en otros países como es el homeschooling.
Abstract
The functions of the institution of parental authority have been in effect throughout the state of alarm decreed by the Government, as well as in the subsequent periods of confinement established to try to prevent the virus. For the resolution of conflicts, the best interests of the minor have been taken into account, in order to avoid harmful disturbances to the children in cases of change of the holder of the custody power or to avoid damages in their family environment or against third parties people. The declaration of the state of alarm did not legitimize the failure to comply with judicial decisions. With the mandatory presence in the schools of minors, new problems have arisen such as those that arise when there is a serious health problem of a partner of the minor, since the case should be assessed by the educational authorities in order to be exempted from attending to school. The question is that in our country there is no alternative regulation to the presence that they do offer in other countries, such as homeschooling.
