Resumen
En este trabajo se examinan los principales tipos de cláusulas incluidas en un contrato de seguro, bajo la perspectiva de ser éste uno de los ejemplos prácticos más frecuentes y paradigmáticos de los contratos de adhesión. Se examinan las características específicas más importantes de esas cláusulas (generales, particulares, delimitadoras del riesgo y limitativas de derechos), particularmente las exigencias formales legales para su control y como protección del adherente tomador del seguro; y asimismo se concluye acerca de la solución a una eventual contradicción entre cláusulas o una oscura o confusa redacción. Asimismo, se analiza la doctrina jurisprudencial consolidada existente en relación a las causas justificativas de exención a la aseguradora del pago de los intereses de demora del artículo 20 LCS; causas que son objeto de interpretación muy restrictiva, especialmente si el proceso judicial controvertido entre la aseguradora y el asegurado perjudicado trae causa de la contradicción u oscuridad en el clausulado del contrato creada por la propia aseguradora.
Abstract
In this paper, the main types of clauses included in an insurance contract are examined, from the perspective of this being one of the most frequent and paradigmatic practical examples of adhesion contracts. The most important specific characteristics of these clauses (general, particular, limiting risk and limiting rights) are examined, particularly the formal legal requirements for their control and as protection of the adherent policyholder of the insurance; and likewise it is concluded about the solution to a possible contradiction between clauses or an obscure or confusing wording. Likewise, the existing consolidated jurisprudential doctrine is analyzed in relation to the justifying causes of exemption to the insurer from the payment of default interest of article 20 LCS; causes that are subject to a very restrictive interpretation, especially if the disputed judicial process between the insurer and the injured insured brings about the contradiction or obscurity in the clauses of the contract created by the insurer itself.
