Resumen
El presente trabajo tiene como objetivo el análisis y la profundización en la materia relativa al tratamiento del fenómeno hereditario en relación con los títulos nobiliarios. Se trata de una disciplina compleja y alejada del conocimiento general de las materias del derecho civil por lo que, a través de la jurisprudencia más reciente, se atenderá a las cuestiones claves que sustentan el fenómeno sucesorio en referencia a los títulos nobiliarios: por un lado, que el título se sucede al fundador y no al último poseedor y, por otro, la cuestión de la interpretación de la igualdad desde la entrada en vigor de la Ley 33/2006, de 30 de octubre, sobre igualdad del hombre y la mujer en el orden de sucesión de los títulos nobiliarios.
Abstract
The present work aims at the analysis and deepening in the matter relating to the treatment of hereditary phenomenon in relation to nobility titles. It is a complex subject and far from the general knowledge in the Civil Law field so, through the most recent jurisprudence, the key issues which support the phenomenon of succession in matters of titles of nobility will be addressed: on the one hand, that the title succeeds the founder and not the last noble title holder and, on the other hand, the question of the interpretation of the equality since the entry into force of Law 33/2006, of 30 October.
