Resumen
En el supuesto de fallecimiento simultáneo y por la misma causa a falta de prueba en contrario tiene lugar la conmoriencia y por consiguiente no tiene lugar la transmisión de derechos de uno a otro. La presunción legal de conmoriencia surge tras el hecho dudoso de la premoriencia en base al cual las personas fallecidas deberían estar llamadas a sucederse entre sí.
Abstract
In the event of simultaneous decease due to the same cause, where there is no evidence otherwise, the death is simultaneous and therefore there is no transfer of rights from one person to the other. The legal presumption of simultaneous death arises after the doubtful fact of predecease, on the basis of which the deceased persons should be called upon to succeed one another.
