COMPLEJOS TURÍSTICOS EN CANARIAS Y EL REGISTRO DE LA PROPIEDAD.

Resumen
La estructura jurídica de los complejos inmobiliarios en las zonas denominadas «destinos turísticos maduros» está sufriendo una profunda crisis de reconversión por la necesidad de renovación física y por el cambio generacional, tanto de las necesidades y gustos de los destinatarios del producto turístico, como de los titulares dominicales de los complejos hoteleros y extrahoteleros.
La institución registral se erige en un elemento de dicho cambio, puesto que la necesidad social de publicidad de la cualidad turístico-administrativa de los complejos es necesaria para el tráfico jurídico inmobiliario y para que los agentes económicos y administrativos adopten las medidas pertinentes.
Si el Registro ha de ser cancerbero del principio de unidad de explotación y denegar las modificaciones jurídico-reales que rompan ese principio y/o si ha de ser cauce para las necesarias modificaciones de la estructura jurídica, destino y uso residencial o turístico, es lo que trata de plantear el presente trabajo.
La experiencia en Canarias respecto a la coordinación registral con el registro administrativo de empresas turísticas y los efectos de dicha publicidad, tal vez pueda servir al resto de las zonas andaluzas, murcianas, levantinas, catalanas y balear con legislaciones análogas.
Abstract
The legal structure of real-estate complexes in the areas termed «mature tourist destinations» is undergoing a profound crisis of renewal, due to the need for physical renovation and the changing of the generational guard, in terms of both the needs and tastes of the people the tourist product is aimed at and the owners of hotel and other complexes.
The registration institution is an element of that change, because the social necessity of publicity about the tourist/ administrative quality of complexes is necessary for real estate trade and for the pertinent measures to be taken by economic and administrative agents.
Whether the registration system has got to be the watchdog of the principle of unity of operation and turn down any legal/real changes that disturb that principle and/or whether it has got to be the channel for the necessary modifications of legal structure, purpose and residential or tourism use is the question this paper attempts to raise.
Experience in the Canary Islands with regard to the registration system's coordination with the administrative registry of tourism enterprises and the effects of said publicity just might be useful for the other Andalusian, Murcian, Levante, Catalan and Balearic areas with similar laws.
