Resumen
Debido a la situación de emergencia sanitaria actual, nuestra economía está experimentado una recesión devastadora, el alcance de la cual todavía es incierto. Lo que sí es previsible es el incremento del número de ejecuciones judiciales forzosas, ante el cual la Administración de Justicia tendrá que dar una respuesta a la alzada de las circunstancias.
Ante esta realidad, con el presente trabajo pretendemos demostrar que es posible una mejor realización forzosa de los bienes a través de fórmulas alternativas a la inoperante subasta judicial. Ello lo confirma la práctica de nuestros tribunales de justicia que pone de manifiesto una mejor respuesta a la reclamación de deudas impagadas cuando la fórmula de apremio escogida es la del artículo 641 de la Ley de Enjuiciamiento Civil.
Abstract
Due to the current health emergency situation, our economy is experiencing a devastating recession, the extent of which is still uncertain. What is foreseeable is the increase of forced judicial executions, before which the Administration of Justice will have to respond according to the circumstances.
This paper aims to show that a better enforcement of goods is possible through alternative mechanisms to the ineffective judicial auction. This is confirmed by the practice of our courts of justice, which shows a better response to the claim of unpaid debts when the chosen mechanism for enforcement is the one who offers article 641 of the Spanish Civil Procedure Law.
