COMENTARIOS A LOS RECURSOS DE LA NUEVA LEY CONCURSAL.

Resumen

La regulación de los recursos prevista en la Ley Concursal se ha visto afectada por cambios significativos durante la tramitación parlamentaria. En el Proyecto se dedicaban a esta materia cuatro artículos, desde el 197 al 200, que finalmente han quedado reducidos a uno solo, aunque con siete apartados como es el artículo 197. Pese a ello, el contenido de la regulación finalmente resultante no es demasiado diferente al inicialmente propuesto, salvo en un punto, en el que se ha introducido un cambio fundamental, el relativo al régimen de recursos de los incidentes concursales en materia laboral, cuestión en la que se ha terminado admitiendo la aplicación del régimen de recursos propio del procedimiento laboral, a la vez que estableciendo la competencia de los órganos jurisdiccionales del orden social.

Abstract

The regulation of appeals under the Law on Meetings of Creditors has undergone significant changes during the parliamentary processing stage. Four articles of the bill, articles 197 to 200, were devoted to the subject of appeals; these have in the end been reduced to a single article, number 197, which does however have seven subparagraphs. Even so, the contents of the finally resulting regulation are not too different from those first proposed, save in one point, where a fundamental change has been introduced concerning the system of appeals for bankruptcy incidents in employer/employee matters. In the end, the application of the system of appeals used in employer/ employee proceedings has been admitted, and labour courts have also been established as the competent authorities.
