Resumen
La legislación concursal con sus reformas están interactuando con la práctica judicial, lo que ha permitido constatar la rapidez con la que se están abordando las carencias, en unos casos y/o imprecisiones legales en otros, dándose respuesta de forma más efectiva a las necesidades que en este ámbito se vienen produciendo; la realidad económica actual ha ido destapando, sin tapujos, que esta LC más que nunca, debe tratarse como mecanismo que aporte al instituto del concurso una mayor seguridad jurídica. Dicho lo cual, es objeto de análisis, el tratamiento y carácter jurídico que la Reforma de la Ley Concursal otorga a la percepción de alimentos por parte del deudor y de un número delimitado y limitado de las denominadas por la Ley Concursal, personas especialmente relacionadas con el concursado.
Abstract
Bankruptcy Law as amended are interacting with the judicial practice, which has revealed the rapidity with which gaps are being addressed, in some cases and / or legal inaccuracies in others, giving a more effective response to needs in this area have taken place, the current economic reality has been uncovering, openly, that the LC more than ever, must be treated as a mechanism to provide competition to institute greater legal certainty. That said, is the subject of testing, treatment and legal status as the Bankruptcy Reform Act gives the perception of food by the debtor and a defined and limited number of so-called by the Insolvency Act, persons specially related the insolvent.
