Resumen
La Ley 41/2007, de Reforma del Mercado Hipotecario, ha modificado el artículo 54 de la Ley de Hipoteca Mobiliaria y Prenda sin Desplazamiento, dando cabida a las prendas sobre derechos sin desplazamiento; nueva figura que ya ha sido tratada por la Resolución de la Dirección General de los Registros y del Notariado, de 18 de marzo de 2008, respondiendo a dos consultas privadas sobre la coexistencia de la nueva prenda sin desplazamiento sobre créditos con la tradicional prenda posesoria.
Abstract
Act 41/2007 reforming the mortgage market amended article 54 of the Act on the Chattel Mortgage and Pledge Without Bailment, making a place for pledges of rights without bailment.
This is a new figure that was discussed by the Directorate-General of Registries and Notarial Affairs' Decision of 18 March 2008 in reply to two private inquiries about the coexistence of the new pledge without bailment on credits and the traditional possessory pledge.
