Resumen
Las donaciones inter vivos, como actos gratuitos que son pueden, porque así lo autoriza el Código de Derecho común, efectuarse por el donante, con carácter de colacionables o no. Por tanto, el negocio jurídico fundamental, participa de los presupuestos esenciales de las relaciones obligatorias y, al tiempo, la nota de la colacionabilidad imputa que dicha declaración de voluntad, esté indeclinablemente unida a las sucesiones por causa de muerte. La donación, bien sabemos que es un modo de adquirir; empero, debemos profundizar en esta vinculación con el Derecho sucesorio. En estas líneas, recapitularemos cómo la suerte de la colación de aquella donatio inter vivos, dependerá de un acto unilateral en que el causante, en sus últimas voluntades testamentarias está autorizado -al tratarse de un elemento de derecho dispositivo- tanto a dispensarla, como a revocarla. En suma, es una de las evidencias de la libérrima autonomía de la voluntad testamentaria.
Abstract
Inter vivos donations, as free acts that are, because they are authorized by the Civil Code, can be made by the donor, whether or not they are collationable. Therefore, the fundamental legal act, participates in the essential assumptions of the obligatory relations and, at the same time, the note of the collusion ability imputes that this declaration of will, is indeclinably linked to the successions by cause of death. The donation, we well know, is a way of acquiring the property; we must study this link with inheritance law. In these lines, we will recapitulate how the collation of that donation inter vivos, depend on a unilateral act in his last wills, is authorized to dispense it, as well as to revoke it. In short, it is one of the evidences of the free autonomy of the testamentary will.
