Resumen
El artículo analiza las características del contrato de arrendamiento financiero y el papel que juega la inscripción en el Registro de la Propiedad y en el Registro de Bienes Muebles, tanto del contrato mismo, como de determinadas cláusulas, como la de opción de compra, que pueden constar en él. A partir de ahí, analiza el tratamiento concursal que le otorga el Real Decreto Legislativo 1/2020, de 5 de mayo, por el que se aprueba el texto refundido de la Ley Concursal. Se recogen sentencias del Tribunal Supremo y resoluciones de la Dirección General de Seguridad Jurídica y Fe Pública de importancia en la materia.
Abstract
This paper analyzes the characteristics of the financial lease contract and the role of the registration in the Property Registry and the Movable Property Registry, both of the contract itself and of certain clauses that may be in it such as the purchase option. From there, it analyzes the bankruptcy treatment granted by the Spanish Royal Legislative Decree 1/2020 of May 5, which approves the revised text of the Bankruptcy Law. It also collects important judgments of the Supreme Court and resolutions of the General Directorate of Legal Security and Public Faith.
