Resumen
El artículo 98 de la Ley 24/2001, de 27 de diciembre, ha modificado de raíz el régimen tradicional español de expresar en las escrituras públicas la intervención en nombre ajeno.
En este trabajo se propone un estudio recapitulativo de las normas, de la jurisprudencia y de la doctrina científica que desde el surgimiento en España del Notariado y del Registro de la Propiedad modernos fueron señalando el modo de proceder sobre este punto.
Este enfoque pretende resaltar la ruptura que se ha producido con el citado artículo 98, y dar pie a la reflexión sobre el alcance que ello pueda tener para el conjunto de las instituciones afectadas.
Abstract
Article 98 of Act 24/2001 of 27 December changed the very root of the traditional Spanish system for expressing, in a deed, that a party is acting on behalf of another.
This paper proposes a recapitulative study of the rules, case law and scientific doctrine that have indicated how to proceed on this point since the modern notarial scheme and property registration system arose in Spain.
This focus endeavours to underline how article 98 broke with tradition and encourage reflection on the scope that can have for the set of institutions affected by the change.
