Resumen
En este trabajo se demuestra que el número abierto es económicamente ineficiente, en comparación con el régimen de numerus clausus en materia de derechos reales. En primer lugar se definen los dos regímenes posibles, numerus clausus y numerus apertus. Luego se analiza cuál es el vigente en España y el debate doctrinario suscitado al respecto. Seguidamente se exponen los argumentos empleados por la dogmática jurídica tradicional para apuntalar cada uno de los sistemas de derechos reales. Todo esto se realiza sintéticamente, pues se presupone que el lector conoce la temática y, además, existen diversas fuentes de esta información, muchas en esta prestigiosa Revista Crítica de Derecho Inmobiliario, citadas en la bibliografía. Finalmente, se afirma que el numerus apertus es un sistema de derechos reales ineficiente en comparación a su opuesto, punto que se aborda exhaustivamente.
Abstract
On this paper I demonstrate that the numerus apertus is economically inefficient, in comparison with the numerus clausus regime. First we define the two possible systems: numerus clausus and numerus apertus. Then we analyze which is the current regime in Spain, and the doctrinarian discussion in that respect. Then we explain the arguments used by the traditional scholars to defend each system. We do that synthetically, because we suppose the reader knows the subject, and also there are enough information about the topic, especially in this prestigious Revista Crítica de Derecho Inmobiliario, aforementioned at the bibliography. Finally, we uphold that the numerus apertus is an inefficient system compared with its opposite, something we analyze exhaustively.
