ADQUISICIÓN DE FINCA DEL ESTADO CON CARÁCTER PRIVATIVO EN BASE AL EJERCICIO DE UN DERECHO DE ADQUISICIÓN PREFERENTE DE NATURALEZA LEGAL, EX ARTÍCULO 137.4.F DE LA LEY 33/2003, DE 3 DE NOVIEMBRE, DE PATRIMONIO DE LAS ADMINISTRACIONES PÚBLICAS: COMENTARIOS A LA RDGRN DE 8 DE MAYO DE 2008.

Resumen
En este trabajo hemos analizado el supuesto de venta realizada por el Estado de una finca rústica no viable económicamente a un propietario colindante a la luz del artículo 137.4.f) de la Ley 33/2003, del Patrimonio de las Administraciones Públicas.
Se comenta la RDGRN, de 8 de mayo de 2008, la cual entiende que la adquisición ha sido realizada por razón del ejercicio de un derecho de adquisición preferente de naturaleza legal, por ello la adquisición se califica de privativa sin que se pueda aplicar la presunción de ganancialidad del artículo 1.361 del Código Civil, la cual debe ceder ante el título adquisitivo que determina la privaticidad de la adquisición, y ello sin perjuicio del derecho de reembolso a la sociedad de gananciales del dinero invertido en la adquisición.
Abstract
This paper analyses a sale by the state of an economically unviable rural property to the owner of a neighbouring property under article 137.4.f) of Act 33/2003 on property owned by the public authorities.
There is a commentary on the Directorate- General of Registries and Notarial Affairs' decision of 8 May 2008, which holds that the purchase was made exercising a preferred legal right to purchase the land, and so the purchase is considered made exclusively by the individual and cannot be presumed to have been made as community property under article 1361 of the Civil Code. Such a presumption is overruled by the purchaser's title, which states the purchase to have been made by the private individual. Even so, the marital partnership is entitled to reimbursement of the money invested in the purchase.
