Resumen

Estamos inmersos en una completa revolución tecnológica que hacen aconsejable y necesaria la adecuación de las normas existentes a las nuevos sistemas, con conceptos novedosos y otros actualizados y con cadenas de valor en las que intervienen múltiples agentes hasta ahora desconocidos o irrelevantes para la Directiva 85/374 sobre responsabilidad por productos defectuosos. Por lo pronto, la propuesta de Reglamento sobre Inteligencia Artificial (2021), a pesar de ser el primer marco normativo sobre la materia, no se ocupa de la responsabilidad civil. De ahí que teniendo en cuenta las relevantes aportaciones que este marco incorpora, sea necesario analizar el concreto régimen especial de responsabilidad civil por producto defectuoso contenido en la Directiva 85/374. Iniciada consulta pública sobre como adaptar este texto a la IA, no podemos perder de vista que incluir estos sistemas de IA en dicho marco normativo no podrá suponer reducir garantías para los perjudicados.

Abstract

We are immersed in a complete technological revolution that makes it advisable and necessary to adapt the existing regulations to the new systems, with new concepts and other updated ones, and with value chains in which multiple agents intervene, hitherto unknown or irrelevant to Directive 85/ 374 on liability for defective products. For now, the proposed Regulation on Artificial Intelligence (2021), despite being the first regulatory framework on the matter, does not deal with civil liability. Hence, taking into account the relevant contributions that this framework incorporates, it is necessary to analyze the specific special regime of civil liability for defective products contained in Directive 85/374. Once the public consultation has begun on how to adapt this text to AI, we cannot lose sight of the fact that including these AI systems in said regulatory framework cannot mean reducing guarantees for those affected.
