Resumen
Las donaciones propter nuptias producen sus efectos desde la celebración del matrimonio, pueden realizarse entre cónyuges (incluso siendo menores, pues la donación se considera contenido de las capitulaciones) e incluso por terceros. La imputabilidad de la causa de separación o divorcio tiene todavía relevancia al permitir al donante revocar la donación aun cuando ya no existe por Ley 15/2005 la separación causal.
Abstract
A donation propter nuptias, or donation by reason of marriage, is effective as of the conclusion of the marriage ceremony. Such a donation may be given from one spouse to another (including even under-age spouses, because this sort of settlement is regarded as part of the marriage articles) and may even be given by a third party. Although since Act 15/2005 became law no legal cause need be claimed in petitions for separation, responsibility for the cause of separation or divorce is still a point of importance, because it allows the giver of a donation propter nuptias to revoke his or her gift.
