Resumen
La entrada en vigor de la Ley 8/2021, de 2 de junio, ha supuesto un cambio sustancial en cuanto al prisma jurídico de las personas con discapacidad eliminando la incapacitación judicial y alterando el sistema de cargos protectores, estableciendo un sistema de medidas de apoyo. Dentro de las medidas de apoyo se contemplan las voluntarias, informales y judiciales, formando parte de éstas últimas la curatela, que normalmente será de carácter meramente asistencial y, excepcionalmente, representativo. El curador representativo actúa en nombre de la persona con discapacidad, requiriendo el Código Civil la autorización judicial previa para determinados actos y la posterior aprobación judicial para otros. El presente artículo tiene por objeto examinar las principales novedades y modificaciones realizadas en la regulación de los actos tipificados en el artículo 287 del Código Civil, con respecto al anterior artículo 271.
Abstract
The entry into force of Law 8/2021, of June 2, has meant a substantial change in the legal perspective of people with disabilities, eliminating judicial incapacitation and altering the system of protective charges, establishing a system of support measures. The support measures include voluntary, informal and judicial measures, the latter being the curatorship, which will normally be of a purely welfare nature and, exceptionally, representative. The representative curator acts on behalf of the person with a disability, the Civil Code requiring prior judicial authorization for certain acts and subsequent judicial approval for others. The purpose of this article is to examine the main developments and changes made in the regulation of acts defined in article 287 of the Civil Code, with respect to the previous article 271.
