Resumen
Súbitamente y sin exponente alguno que permitiera a los analistas preverlo, desde el otoño del 2007, el mundo entero se ha visto inmerso en una profunda crisis financiera. El comprador de vivienda sobre plano, también se ha visto sorprendido "in fieri" por un mercado depresivo y en su lucha por buscarse una oferta a la baja, mucho más atractiva, resuelve arbitrariamente su anterior contrato, obligatorio y vinculante, tomando como pretexto la vacua, (por estricta), "literalidad" de una Ley de 1968, que regula la garantía de devolución de aquellas cantidades anticipadas por el comprador en la construcción y cuyo único fin es evitar la estafa del vendedor.
Abstract
Suddenly, and without any precursors enabling analysts to predict it, since autumn 2007 the entire world has been immersed in a severe financial crisis. Off-plan property buyers have also been startled in fieri by a bearish market, and, in their struggle to find a cheaper, much more attractive housing offer, they may arbitrarily cancel their previous obligatory, binding contract on the pretext of the "letter" of the Act of 1968 regulating the guaranteed refund of sums advanced by the buyer. The terms of the act, whose sole intent is to avoid fraud by the seller, are so very strict as to be vacuous.
