Resumen
Son muchas las sentencias y aspectos jurídicos que podemos encontrar en un tema tan práctico y tan usual sobre el funcionamiento de las relaciones económicas entre los cónyuges, no exentos de polémicas jurídicas, sobre todo cuando se trata de desvincular la responsabilidad de los bienes gananciales acudiendo a la vía del nuevo pacto de capitulaciones matrimoniales.¿se pueden comprometer los bienes comunes por actuación individual de uno sólo de los cónyuges? ¿responden los bienes gananciales o los privativos del cónyuge actuante? Estos interrogantes y otros que iremos viendo los trataremos de resolver en el estudio presentado.
Abstract
Many are the court rulings and legal aspects to be found in an issue as practical and commonplace as the workings of economic relations between spouses. There is no lack of legal controversy, especially when the point at issue is the use of the new agreement on marriage articles to disentangle community property from liability. Can jointly owned property be compromised by just one spouse acting individually? Can liability be exacted through the couple's community property or the acting spouse's private property? We shall endeavour to settle these questions and others that we shall see in this study.
