A PROPÓSITO DE UNA PRETENDIDA TEORÍA GENERAL DE LOS CONTRATOS CONEXOS.

Resumen
En virtud del fenómeno de la conexión contractual, los particulares celebran de manera simultánea o sucesiva diversos contratos que guardan entre sí un vínculo de dependencia, a los fines de alcanzar un determinado resultado económico, de tal forma que las vicisitudes que afectan a uno de ellos (vigencia, cumplimiento, incumplimiento, interpretación) repercuten en el otro y viceversa.
Su fundamento radica en el principio de la autonomía de la voluntad y, aun cuando el carácter aislado y el principio de la relatividad del contrato han supuesto sus mayores obstáculos, una nueva lectura del contrato, sin prescindir de sus reglas tradicionales ya consagradas, nos permite concebirlo como una institución adaptada a los tiempos e impuesta por una nueva realidad socioeconómica y jurídica.
Abstract
By virtue of the phenomenon of the contractual connection, the individuals celebrate of simultaneous way or successive diverse contracts that to each other keep a bond from dependency, to the aims to reach a certain economic result, of such form which the vicissitudes that affect to one of them (use, fulfillment, breach interpretation) repels vice versa in the other and. Its foundation is in the principle of the autonomy of the will and, even though the isolated character and the principle of the relativity of the contract have supposed their greater obstacles, a new reading of the contract, without doing without their traditional rules already consecrated, it allows us to conceive it like an institution adapted to the times and imposed by a new socioeconomic and legal reality.
