Resumen
La cesión de bienes en pago y para pago de deudas reviste una especial trascendencia en situaciones de insolvencia patrimonial y, en concreto, en el concurso de acreedores, en cuyo marco normativo situamos esta figura de honda raigambre histórica y de continua actualidad social y frecuencia práctica. Con ocasión de la reciente Resolución de la Dirección General de los Registros y del Notariado, de 27 de febrero de 2012, se examinará el significado y sentido de la regulación restrictiva que de la cesión de bienes y de la dación en pago realiza la vigente regulación concursal.
Abstract
Assignment in and for payment of debts to creditors is especially important in insolvency situations and, more to the point, in meetings of creditors, in whose legislative framework the concept of assignment for the benefit of creditors is placed. The concept is one that has deep historic roots, ongoing social relevance and frequent practice. Current bankruptcy regulations take a restrictive view of assignment for the benefit of creditors and surrender in lieu of payment. On the occasion of the recent Decision of the Directorate-General of Registries and Notarial Affairs of 27 February 2012, the meaning of this restrictive stance and the sense behind it are examined.
