Resumen
En este trabajo hemos analizado la existencia de un contrato de arrendamiento de local de negocio celebrado después de la entrada en vigor de la LAU de 1964 en base al criterio jurisprudencial sentado en Sentencia del TS de 21 de Mayo de 2009, la cual considera que en estos casos no es aplicable el artículo 108 de esta ley relativo a la repercusión de las obras necesarias en el arrendatario ya que en la actualidad impera la libertad de las partes para determinar las rentas y sus sistemas de actualización.
Abstract
In this paper we have analysed the existence of a business lease made after the Urban Lease Act of 1964 took force. The analysis is conducted on the basis of the jurisprudential criteria set in the Supreme Court ruling of 21 May 2009, which considers that in such cases section 108 of the ULA concerning charging the tenant for the costs of necessary improvements is not applicable, whereas at the present time the parties are free to establish rent levels and rent updating systems.
