Resumen
Por lo general, en el Derecho las acciones, actos y situaciones jurídicas positivas son las que producen efectos jurídicos, pero en ciertas circunstancias también la omisión y el silencio pueden producir esos efectos, unas veces en contra y otras a favor de quien lo guarda.
Los efectos jurídicos del silencio se presentan en todas las ramas del Derecho.
En este trabajo se estudia el valor jurídico del silencio en materia civil, procesal, administrativa y constitucional. Una buena parte de la obra se dedica al silencio constitucional, que se manifiesta principalmente cuando el Legislativo no dicta una ley que la Constitución mandata a dictar (inconstitucionalidad por omisión; por ejemplo, la falta de regulación de la unión de hecho estable, art. 72 de la Constitución). A este respecto, se hace un amplio estudio de la figura del silencio constitucional en diversos países de América Latina y Europa, y se explica el modo en que se aborda este problema en el sistema de justicia constitucional nicaragüense.
Concluye el trabajo con una reflexión sobre el futuro de la institución estudiada.
Abstract
Generally speaking, in the law, positive legal situations, acts and actions are those situations, acts and actions that have legal effects; but in certain circumstances omission and silence can have legal effects as well, sometimes against and sometimes in favour of the omitting or silent person. The legal effects of silence appear in all branches of the law.
This paper studies the legal value of silence in civil, procedural, administrative and constitutional law. A considerable portion of the paper deals with constitutional silence, which is manifested primarily when the legislative branch fails to issue a law that is its constitutional mandate to issue (unconstitutionality by omission; for example, failure to regulate stable de facto unions, Spanish Constitution, article 72). In this respect, a wide-ranging study is made of constitutional silence in various countries of Latin America and Europe, and an explanation is given of how this problem is addressed in the Nicaraguan system of constitutional justice. The paper concludes with a reflection on the future of the institution in question.
