Resumen
El presente trabajo analiza la evolución jurisprudencial llevada a cabo por parte del Tribunal Supremo y de las Audiencias Provinciales con respecto a los contratos de crédito o tarjetas revolving, hasta llegar a la reciente STS nº 367/2022, de 4 de mayo, a fin de averiguar si se ha dado una solución definitiva a la cuestión de cuándo debe considerarse usurario un determinado tipo de interés pactado. Se analizan las sentencias en virtud de las diferentes vías procesales para reclamar, comparando los resultados obtenidos en función de si se ejercita una acción de nulidad por usura o bien si se ejercita una acción de nulidad de la cláusula del tipo de interés por falta de transparencia, en la cual entra en juego el llamado doble control de transparencia (formal y material).
Abstract
The present work analyzes the jurisprudential evolution carried out by the Supreme Court and the Provincial Courts with respect to credit contracts or revolving cards, until the recent STS nº 367/2022, of May 4, in order to find out if a definitive solution has been given to the question of when a certain agreed interest rate should be considered usurious. The sentences are analyzed by virtue of the different procedural channels to claim, comparing the results obtained depending on whether an action of nullity is exercised for usury or if an action of annulment of the interest rate clause is exercised due to lack of transparency, in which the so-called double control of transparency (formal and material) comes into play.
