HACIA UN CONCEPTO CLARIFICADOR DE SERVICIO. EL CONTRATO DE SERVICIOS COMO TIPO CONTRACTUAL GENERAL.

Resumen
Mediante el presente trabajo, el autor examina el actual concepto legal de servicio en nuestro Derecho vigente y examina las razones históricas que llevaron al codificador a establecer un tipo contractual de servicios y otro de obra, enmarcados ambos en la figura del arrendamiento.
Diferenciar un tipo contractual de otro, y encontrar el criterio diferenciador propicio, ha sido un desafío histórico en nuestro Derecho. En este trabajo se examinan estos criterios, se ponen de relieve los inconvenientes de los mismos y se propone, junto con las últimas tendencias doctrinales, la adopción de uno de ellos. Igualmente, el autor, establece algunas consideraciones sobre cómo debería reformarse nuestro Derecho en el ámbito del contrato de servicios, proponiendo la existencia de un tipo contractual único de contrato de servicios -el actual arrendamiento de servicios- y un nuevo contrato de edificación que se identificaría con el actual contrato de obra.
Abstract
In this paper the author examines the current legal concept of «service» in the legislation now in force and examines the historical reasons that led lawmakers to establish one type of contract for services and another for works, both being within the framework of the concept of «rental». It is a historical challenge of Spanish law to differentiate one type of contract from the other -and to find the right differentiating criterion. This paper examines these criteria, highlights their drawbacks and proposes, together with the latest trends in doctrine, the adoption of one of them. The author moreover shares a number of considerations about how service-contract legislation should be reformed. The author proposes a single type of service contract (the current contract for the renting of services) and a new building contract that would be tantamount to today's works contract.
