Resumen
La utilización de la cámara oculta como una herramienta del periodismo de investigación es una realidad presente en diferentes formatos televisivos y ocasiona una serie de litigios relacionados con la vulneración de derechos fundamentales, en particular, el derecho a la propia imagen. Este trabajo presenta un análisis crítico de la doctrina constitucional sobre la libertad de información reflejada en la STC 25/2019, en lo que respecta a su impacto en la jurisprudencia sobre responsabilidad civil por intromisión ilegítima en el derecho a la propia imagen y reflexiona sobre el futuro de su protección en ese ámbito.
Abstract
The use of the hidden camera as a tool of investigative journalism is a reality present in different television formats and causes a series of disputes related to the violation of fundamental rights, in particular the right to one’s own image. This work presents a critical analysis of the constitutional doctrine on freedom of information reflected in STC 25/2019, with regard to its impact on the jurisprudence on civil liability for illegitimate interference with the right to one’s own image and reflects on the future of its protection in this area.
